Present: Shelly Wharton, Paul Vereb, Ray Olexa, Don Bican, Brent Osborn, Bob Locher, Joanne Dodaro, Cathy Osborn, Dale Zickefoose

Absent: none

Guests: Mr. & Mrs. Byers, Doug Schmotzer

 

Meeting called to order at 7:35pm. Recorder on.

 

Motion by Vereb, 2nd by Osborn to approve the minutes of the 110107 meeting as presented, all in favor, motion carried.

 

Motion by Vereb, 2nd by Bican to approve the minutes of the 111907 special session as corrected, all in favor, motion carried.

 

Wharton will forward the corrected version of the minutes to members and C. Osborn for Council.

 

Old Business:

 

Kissling: Locher took photos and circulated them to the Board. He will check on the progress weekly. No complaint thus far.

 

Schmitt: nothing.

 

Moats: Lee Lore common driveway. Locher circulates original application by Christy Moats and the survey attached. Discussion had. Cut in driveway is 1.5’ on her side of drive. Michelson was emailed the information by Locher so charges can be prepared. Locher will follow through this week. Locher has recent photos. Schmotzer suggests rather than charging her the Board attaches a lien on her property so that it cannot be sold until it is fixed. Advised that the Board has tried to be accommodating and she has still not corrected the drive and therefore will be charged. Locher advises that the Village might have to pay for a survey to enforce the action. Mayor Dodaro states the Council will stand behind the Zoning Board and any actions and associated costs.

 

Wendy James: Beachside. Permits signed. Locher has recent photos which are circulated and reviewed.

 

Byers: Briarwood Blvd. fence. Hugo Byers just received the letter tonight from Locher. The current fence is 11’ from the right of way. Locher has plotted to choices to scale: 1) straight line or 2) 45 degree angles. Plan reviewed. Mrs. Byers advises they wanted 16” behind the hot tub in the corner which abuts the fence in order to remove and replace the cover. Each line on the plot is 2’. The 45 degree angle choice puts the fence approximately 37’ from the house and still well behind the right of way. The Byers like the 45 degree option. Locher will sketch the choice to scale and the Byers will need to apply for a 2nd variance. Forms provided. Another check will also be required (Locher to check with Michelson to be sure). All Zoning Board members in agreement that this will suffice. No motion can be had due to the variance process.

 

Symes: Beachside Blvd. Locher has heard nothing to date.

 

Heffelman: 171 Rockridge trash cans – goes to court next week.

 

117 Clovercliff abandoned structure. Locher reports that he spoke with a Council person from Gloria Glens about condemning procedure and was advised that the Village would have to pay to do so. The Fire Dept. Has complained about the structure. Windows are broken. Locher reported to Sheriff Dept. so that they will provide extra watch in order to prevent vandalism. There are 3-4 houses in that area that are in ill repair. Banks own the properties. Discussion about contacting the Health Dept. – this has been done before with no result. Locher to follow up with Michelson to determine the action possibilities.

 

New Business:

 

Doug Schmotzer owner of vacant lot on Lee Lore beside Bob Moats needs the flood plain regulations. He was advised they were on the website. Wharton advises this is the old, 1 paragraph ordinance. C. Osborn provides copy. She will request Katrina put the new regulation on the website Ordinance 596-04.

 

Mayor Dodaro advises she is having difficulty finding a replacement for Brent Osborn who has expressed a desire to resign from the Zoning Board. She requests that he stay until such time as she can find a qualified replacement. Osborn agrees to do so.

 

Mayor Dodaro states that the Zoning Board is doing a good job and she appreciates the hard work. Councilperson Olexa agrees.

 

Wharton motions, 2nd by Vereb, to adjourn the meeting, vote taken, all in favor, meeting adjourned at 8:25pm.
