ENFORCEMENT
SECTION 1001 ZONING INSPECTOR
A zoning inspector shall be employed to enforce this Zoning Ordinance.
The term of employment, rate of compensation, and other such conditions
shall be set by the Village Council.
SECTION 1002 ZONING PERMITS REQUIRED
No building or other structure shall be erected, moved, added to,
structurally altered, nor shall any building structure, or land be established
or changed in use without a permit therefore, issued by the Zoning
Inspector. A permit is only valid when signed by the Zoning Inspector
issuing said permit and at least one current member of the Village Zoning
Board. In the absence of the Zoning Inspector, a valid permit may be
issued when signed by two (2) current members of the Zoning Board.
Zoning permits shall be issued only in conformity with the provisions of
this ordinance unless the Zoning Inspector receives a written order from
the Zoning Board deciding an appeal, conditional use, or variance.
SECTION 1003 ZONING PERMIT APPLICATION
A. The applications shall include the following information:
1. A plot plan drawn to scale showing the exact dimensions of the lot to
be built upon.
2. The location, dimensions, height, and bulk of structures to be erected.
3. The intended use.
4. The proposed number of sleeping rooms, dwelling units, occupants
and other uses.
5. The yard, open area, and parking space dimensions and locations.
6. Any other pertinent data as may be necessary to determine and provide
for the enforcement of this Ordinance.
7. Name and mailing address of applicant, also the name and
address of the property owner if different then the applicant.
8. The application fee.
B. The Application shall be submitted to the Zoning Inspector. The Zoning
Inspector will review the application within 10 days of receipt . The
Zoning Inspector can approve the application and issue the permit, per
requirements of Section 1002 of this Ordinance, or he may present the
application to the full committee at the next scheduled meeting, within 30
days of the application date. .
C. The zoning permit shall become void at the expiration of one year after
date of issuance unless construction is started. If no construction is started
within one year of date of permit, a new application and permit are
required. Once construction is started, it must be completed within one year.
SECTION 1004 SCHEDULE OF FEES, CHARGES, AND EXPENSES
The Village Council has by ordinance established a schedule of fees,
charges and expenses, and a written procedure for zoning permits,
amendments, appeals, variances, conditional use permits, site plan
approvals, and other matters pertaining to the administration and
enforcement of this Ordinance requiring investigations, inspections, legal
advertising, postage and other expenses. (See Ordinance No. 474-98.)
A. The following shall be the fees for the listed procedures under the
Zoning Ordinances of the
1. Residential Zones
a. Structural changes, alterations and additions:
Building Permit $35.00
Variance $50.00
Appeal to Council $60.00
b. New construction:
Building Permit $200.00
Variance $ 50.00
Appeal to Council $ 60.00
2. Commercial and Light Industrial Zones
a. Structural changes, alterations, and additions:
Building Permit $ 70.00
Variance $100.00
Appeal to Council $120.00
b. New construction:
Building Permit $400.00
Variance $100.00
Appeal to Council $120.00
c. The charge for a copy of the Codified Zoning Ordinance of the
Village shall be $50.00 and the charge for a copy of a Map
Set of the Village showing the various zones shall be $25.00.
SECTION 1005 VIOLATIONS
Buildings erected, altered, moved, razed, or converted, or any use of land
or premises carried on in violation of any provision of this Ordinance are
declared to be a nuisance per se.
SECTION 1006 INSPECTION AND CORRECTION OF VIOLATIONS
It shall be the duty of the Zoning Inspector to see that any building
erected, altered, moved, razed, or converted, or any use of land or
premises carried on in violation of any provision of this Ordinance is
inspected and the Zoning Inspector shall declare each violation a nuisance
and, in writing, order correction of all conditions which are found to be in
violation of this Ordinance.
SECTION 1007 CORRECTION PERIOD
All violations shall be corrected within the period time as indicated by the
Zoning Inspector in the written order. Any violations not corrected within
the specified period of time shall be prosecuted.
SECTION 1008 PENALTIES
Any person, firm, or corporation violating any provisions of this Zoning
Ordinance, or supplements or amendments thereto, shall be deemed guilty
of a misdemeanor and, upon conviction thereof, shall be fined not less
than $50.00 nor more than $500.00. Each days' continuation of a violation
of this Ordinance shall be deemed a separate offense. Nothing herein
contained shall prevent the Village from taking such other lawful action as
is necessary to prevent or remedy any violation.
SECTION 1009 COMPLAINTS REGARDING VIOLATION
Whenever a violation of this Ordinance occurs, or is alleged to have
occurred, any person may file a written complaint. Such complaint stating
fully the causes and basis thereof shall be filed with the Zoning Inspector.
The Zoning Inspector shall record properly such complaint, immediately
investigate, and take action as provided by this Ordinance.
